Influencer Agreement & Creator Terms

These Influencer Agreement & Creator Terms (“Creator Terms”) govern the relationship between InfluencersPlace (“InfluencersPlace,” “we,” “us,” or “our”) and influencers, content creators, artists, bloggers, social media personalities, UGC creators, and other individuals or entities (“Creator,” “you,” or “your”) who register with, are listed on, receive opportunities through, or participate in campaigns arranged by InfluencersPlace.
Creator Terms, here provided, should be read along with our Terms and Conditions, Privacy Policy, Refund & Cancellation Policy, individual campaign briefs, and any other written agreement applicable to a specific campaign. However, these terms are subject to change from time to time, and the burden of being up-to-date with these changes lies solely on all types of users of the platform.
By registering as a Creator, submitting your profile, accepting a campaign, or using InfluencersPlace services, you agree to these Creator Terms.
1. Eligibility
To register or participate as a Creator, you must:
- Be at least 18 years old or
- Have the consent and involvement of a parent or legal guardian where permitted for creators under 18
- Be legally capable of entering into an agreement, enforceable by law
- Own, operate, manage, or be properly authorized to represent the social media accounts submitted to InfluencersPlace
- Provide accurate and current information
- Comply with applicable laws, advertising standards, and platform policies
InfluencersPlace may request identity, age, address, tax, social media ownership, audience, or other verification information where reasonably necessary. And if you want to successfully complete the registration process, you are required to provide all these details upon request.
2. Creator Registration
Creator’s registration requires an altogether different set of data. They may be required to complete a registration form, filling in the following types of information.
- Name
- Creator or stage name
- Contact information
- Location
- Social media profiles
- Follower or subscriber information
- Creator category or niche
- Portfolio
- Bio
- Content rates
- Audience information
- Engagement statistics
- Other information relevant to potential campaigns
You confirm that all information submitted is accurate, genuine, and not misleading. You must update InfluencersPlace if material information on your profile changes. Your registration is subject to suspension or deletion in case of any discrepancy found. The consequences of such errors, if any, will be solely borne by the user or any other concerned person on their behalf.
3. Registration and Listing Fees
InfluencersPlace may charge fees for creator registration, verification, profile creation, listing, featured placement, priority visibility, or other promotional services.
The applicable price and benefits will be displayed at the time of purchase.
Payment of a creator registration or listing fee:
- Does not guarantee campaign opportunities.
- Does not guarantee a specific number of brand enquiries.
- Does not guarantee earnings.
- Does not guarantee selection by any particular brand.
- Does not create an employment relationship with InfluencersPlace.
Refunds for registration and listing services are governed by the InfluencersPlace Refund & Cancellation Policy. All users are subject to these terms and conditions, and they must have a sound knowledge of this entire framework.
4. Creator Profile
By registering, you authorize InfluencersPlace to create and display a public or restricted-access creator profile using information you provide.
Your profile may include information such as:
- Name or creator name
- Profile photograph
- Social media handles
- Category or niche
- Location
- Followers or subscribers
- Engagement information
- Portfolio
- Previous collaborations
- Content examples
- Rates
- Audience demographics
- Verification status
- Other professional information
By submitting such information, you authorize InfluencersPlace to display this information to potential brands, agencies, advertisers, and other users for creator discovery and campaign purposes.
You retain ownership of your original content and intellectual property except for the limited permissions granted under these Creator Terms.
5. No Guarantee of Campaigns
Registration with InfluencersPlace does not guarantee that you will receive or be selected for campaigns. Campaign selection may depend on the following factors, but is not limited to these.
- Brand requirements
- Creator niche
- Audience demographics
- Location
- Engagement
- Content quality
- Campaign budget
- Availability
- Previous campaign performance
- Brand suitability
- Platform
- Pricing
- Compliance history
The final creator selection may be made by InfluencersPlace, the relevant brand, or both depending on the campaign. Make sure that all the information you provide is accurate and free of errors.
6. Campaign Invitations
InfluencersPlace may contact you regarding potential campaigns. A campaign opportunity may specify the following items. Get to know about these in advance so that you don’t have any objections later.
- Brand
- Product or service
- Platform
- Required content
- Number of deliverables
- Content format
- Campaign timeline
- Posting dates
- Compensation
- Product benefits
- Usage rights
- Exclusivity
- Content approval requirements
- Reporting requirements
- Advertising disclosure requirements
- Other campaign-specific conditions
You may accept or decline a campaign unless otherwise agreed. Additionally, you should review all campaign requirements before accepting. If you have accepted a campaign first, you will become bound by the terms up to the extent of irrevocability.
7. Campaign Acceptance
Once you expressly accept a campaign, the applicable campaign brief becomes binding.
By accepting, you confirm that:
- You can complete the required deliverables;
- You can meet the agreed deadlines;
- Your quoted or agreed rates are accurate;
- You have disclosed potential conflicts of interest;
- You understand the content requirements; and
- You have sufficient rights and permissions to produce the content.
You should not accept campaigns that you cannot reasonably complete.
8. Creator Deliverables
Creators must provide all deliverables specified in the applicable campaign brief.
Deliverables may include:
- Instagram Reels
- Instagram posts
- Stories
- YouTube videos
- YouTube Shorts
- Community posts
- TikTok videos
- Facebook content
- X posts
- Blog content
- UGC videos
- Photographs
- Live streams
- Reviews
- Event appearances
- Affiliate content
- Other agreed promotional material
Deliverables must substantially comply with the approved campaign brief.
9. Content Quality
Creators must produce content that is:
- Original or properly licensed;
- Professionally presented according to the campaign requirements;
- Suitable for the Creator’s audience;
- Factually accurate regarding the promoted product or service;
- Free from unauthorized copyrighted material;
- Free from fraudulent or misleading claims;
- Compliant with applicable advertising requirements; and
- Consistent with the approved campaign brief.
Creators should not make product, medical, financial, performance, environmental, or other claims that have not been authorized or reasonably substantiated.
10. Content Approval
Certain campaigns may require approval before publication.
Where approval is required, the Creator must submit draft content within the specified timeframe.
The Creator must not publish content requiring approval until the necessary approval has been received from InfluencersPlace and/or the brand.
InfluencersPlace or the brand may request reasonable revisions where content:
- Does not follow the campaign brief;
- Contains incorrect information;
- Omits required disclosures;
- Does not meet agreed production requirements;
- Includes inappropriate or unauthorized material; or
- Otherwise materially fails to meet campaign requirements.
Reasonable revision requirements form part of the agreed deliverables.
11. Creator’s Authentic Voice
Unless the campaign expressly requires specific wording necessary for legal, factual, branding, or disclosure purposes, Creators should retain reasonable creative freedom.
Creators should not be required to make statements they know to be false.
Where a campaign involves a review, testimonial, or personal experience, the Creator must provide a genuine representation of their experience and must not make deceptive claims.
12. Sponsored Content Disclosure
Creators must clearly disclose commercial relationships with brands where required.
This obligation may apply where the Creator receives:
- Monetary payment
- Free products
- Gifts
- Discounts
- Travel
- Accommodation
- Services
- Affiliate commissions
- Event access
- Barter arrangements
- Other benefits or incentives
Creators must use disclosures that comply with applicable advertising standards, laws, and platform requirements.
Depending on the campaign and platform, appropriate labels may include terms such as:
Ad, Advertisement, Sponsored, Collaboration, Partnership, Affiliate, Free Gift, or the applicable platform’s built-in paid partnership or paid promotion disclosure.
The disclosure must be clear, prominent, easily understandable, and appropriately positioned.
Hiding advertising disclosures at the end of a long caption, among numerous hashtags, or in a location unlikely to be noticed may not satisfy campaign requirements.
Creators participating in campaigns targeting Indian audiences must follow applicable Indian advertising requirements, including relevant ASCI influencer advertising guidelines.
13. Platform Rules
Creators are responsible for complying with the policies of the platforms on which they publish content, including where applicable:
- YouTube
- TikTok
- X
- Snapchat
- Twitch
- Other social or digital platforms
InfluencersPlace is not responsible for content removals, account restrictions, demonetization, suspensions, or other platform enforcement resulting from a Creator’s violation of platform policies.
14. Authentic Audience and Engagement
Creators must not intentionally misrepresent audience size, engagement, reach, impressions, views, clicks, conversions, or other performance information.
Prohibited conduct includes:
- Purchasing fake followers;
- Purchasing fake views or engagement;
- Using bots to manipulate campaign performance;
- Fabricating screenshots;
- Editing campaign analytics to misrepresent performance;
- Using click farms;
- Artificially inflating impressions or reach; or
- Providing knowingly false audience demographics.
InfluencersPlace may suspend or permanently remove Creators found to have materially manipulated campaign or profile data.
Payment may also be withheld for fraudulent or materially manipulated campaign activity to the extent permitted by applicable law and the relevant agreement.
15. Analytics and Campaign Reporting
Creators must provide reasonably requested campaign analytics after publication.
This may include:
- Reach
- Impressions
- Views
- Likes
- Comments
- Shares
- Saves
- Story views
- Watch time
- Clicks
- Audience demographics
- Conversion information
- Other campaign-specific metrics
Unless a different timeframe is specified in the campaign brief, requested analytics should normally be provided within 7 days of publication.
Screenshots or platform-generated analytics must be authentic and unaltered.
16. Content Live Period
Creators must keep sponsored content live for the minimum period stated in the campaign brief.
If no minimum period is specified, Creators should not remove campaign content without first consulting InfluencersPlace during the active campaign period.
A Creator may remove content where continued publication would violate law, platform requirements, or create a legitimate safety concern, but should notify InfluencersPlace where reasonably possible.
17. Creator Compensation
Creator compensation will be stated in the applicable campaign brief or otherwise agreed in writing.
Payment may consist of:
- Fixed monetary payment;
- Product or service barter;
- Affiliate commission;
- Performance-based compensation;
- Gift vouchers;
- Travel or experience benefits;
- A combination of compensation methods; or
- Another mutually agreed arrangement.
Creators should confirm the compensation structure before accepting a campaign.
18. Payment Conditions
Unless otherwise agreed, payment may depend on completion of required campaign obligations, including:
- Submission of approved content;
- Publication of deliverables;
- Compliance with the agreed campaign brief;
- Completion of required revisions;
- Submission of requested analytics;
- Submission of valid payment information; and
- Submission of applicable tax or identity documentation.
Failure to complete material campaign obligations may delay or affect payment.
InfluencersPlace will not withhold undisputed earned amounts arbitrarily.
19. Taxes
Creators are responsible for their own income tax, GST, or other tax obligations arising from payments received through campaigns where applicable.
InfluencersPlace may request legally required documentation including:
- PAN
- GST details
- Invoice
- Bank information
- Identity verification
- Other tax-related documentation
InfluencersPlace may deduct or report taxes where required by applicable law.
20. Creator Rates
Creators may provide indicative rates for different content formats.
Displaying a rate on a Creator profile does not necessarily create a binding offer.
Campaign rates may vary depending on:
- Scope
- Usage rights
- Production requirements
- Exclusivity
- Turnaround time
- Paid media usage
- Travel
- Campaign duration
- Deliverable quantity
- Other commercial requirements
Final compensation will be determined by the agreed campaign terms.
21. Intellectual Property Ownership
Unless otherwise agreed in writing, the Creator retains ownership of original campaign content created by the Creator.
However, accepting a campaign may grant the brand and InfluencersPlace limited rights necessary to use the content according to the applicable campaign brief.
The Creator warrants that they have the necessary rights to all elements included in their content.
22. Brand Content Usage Rights
Usage rights must be determined by the relevant campaign agreement or brief.
They may include rights to:
- Repost campaign content;
- Share content on brand social channels;
- Display content on websites;
- Include content in campaign reports;
- Use content in presentations;
- Use content in organic marketing;
- Use content in paid advertising;
- Boost Creator posts;
- Whitelist Creator content;
- Edit or adapt content;
- Use Creator name, likeness, handle, or image.
Where extended commercial usage, paid advertising, whitelisting, perpetual use, or broad licensing rights are required, these should be communicated to the Creator as part of the campaign terms.
Creators should not assume that ordinary campaign compensation automatically includes unlimited or perpetual advertising rights unless expressly agreed.
23. InfluencersPlace Portfolio Rights
Unless otherwise agreed, the Creator permits InfluencersPlace to reference completed campaign work for reasonable business and portfolio purposes, including:
- Case studies
- Campaign reports
- InfluencersPlace social media
- Sales presentations
- Website portfolio sections
- Marketing materials
This permission does not transfer ownership of the Creator’s underlying intellectual property.
Confidential campaigns will not be publicly disclosed where confidentiality has been expressly agreed.
24. Name, Image and Likeness
Where reasonably necessary for Creator discovery and campaign promotion, you authorize InfluencersPlace to display your:
- Creator name
- Profile image
- Public social media handle
- Public profile information
- Campaign content
- Professional biography
This authorization remains subject to applicable privacy and intellectual property rights.
25. Music, Images and Third-Party Content
Creators are responsible for ensuring they have adequate rights to use music, footage, images, logos, fonts, photographs, clips, or other third-party content included in campaign material.
Creators should pay particular attention to music licensing where content may be repurposed for commercial or paid advertising.
26. Brand Assets
Any brand trademarks, logos, graphics, scripts, product photographs, confidential campaign materials, or other assets supplied to the Creator remain the property of their respective owners.
Creators may use such assets only for the applicable campaign unless otherwise authorized.
27. Exclusivity
A campaign may include category or competitor exclusivity.
Any exclusivity requirements should identify, where appropriate:
- Restricted competitors or category;
- Duration;
- Territory;
- Social platforms; and
- Other relevant restrictions.
Creators must disclose existing commitments that could conflict with a campaign before accepting it.
28. Conflicts of Interest
Creators must disclose material conflicts that could affect a campaign.
This may include:
- Existing competitor campaigns;
- Employment relationships;
- Ownership interests;
- Personal or financial relationships with the promoted business;
- Contractual restrictions; or
- Other circumstances that could materially affect the Creator’s participation.
29. Confidentiality
Creators may receive confidential information relating to:
- Unreleased products
- Campaign launches
- Marketing plans
- Pricing
- Customer information
- Brand strategy
- Creator lists
- Campaign budgets
- Business information
- Login or access credentials
Creators must not disclose confidential information without authorization.
Confidential information does not include information that is already lawfully public through no breach by the Creator.
30. Embargoes
Creators must respect campaign embargo dates.
Content relating to unreleased products, announcements, campaigns, or other confidential material must not be published before the agreed publication date.
31. Non-Circumvention
InfluencersPlace invests resources in identifying creators, sourcing brand opportunities, negotiating campaigns, managing relationships, and facilitating collaborations.
Where InfluencersPlace introduces a Creator to a brand for a commercial opportunity, the Creator must not intentionally bypass InfluencersPlace to avoid agreed campaign fees or commissions relating to that opportunity. That will immediately lead to a clear violation of the policy.
Unless a different period is specified in writing, this restriction applies to substantially related commercial opportunities with a brand first introduced through InfluencersPlace for 12 months from the introduction.
This provision does not prevent a Creator from working with a brand where the Creator can reasonably demonstrate a genuine pre-existing commercial relationship independent of InfluencersPlace. However, in that case, the Creator will have to furnish sufficient evidence to allow us to believe in the existence of such pre-existing relationship.
32. Direct Brand Communication
InfluencersPlace may permit Creators and brands to communicate directly where useful for campaign execution. However, direct communication does not automatically remove InfluencersPlace from the campaign arrangement. And while communicating thus, the creators are supposed to maintain all decorum and decency. Otherwise, in case of inappropriate behaviour, their registration or relationship with our platform might be met with a penalizing action.
Any campaign fee, commission, management arrangement, or other commercial obligation already agreed remains applicable during the imposition of all types of penalties.
33. Creator Cancellation
Creators should accept campaigns only when reasonably confident they can complete them.
If you need to cancel after accepting a campaign, notify InfluencersPlace as soon as possible.
InfluencersPlace may consider factors including:
- Reason for cancellation;
- Notice provided;
- Whether production has started;
- Brand commitments;
- Costs already incurred;
- Previous cancellation history.
Repeated unjustified cancellations may result in reduced campaign eligibility, profile suspension, or removal from the platform.
34. Failure to Deliver
If a Creator fails to provide agreed deliverables without a valid reason, InfluencersPlace may take reasonable action including:
- Requesting completion;
- Extending a deadline;
- Requesting repayment of an advance;
- Cancelling unpaid amounts associated with undelivered work;
- Providing the brand with a replacement creator;
- Restricting future campaign eligibility; or
- Suspending or terminating the Creator account.
Any remedy will depend on the circumstances and applicable campaign agreement.
35. Brand Cancellation
Where a brand cancels a campaign after a Creator has accepted it or started work, Creator compensation will depend on:
- Work already completed;
- Non-refundable expenses;
- Production stage;
- Agreed cancellation terms; and
- The relevant campaign brief.
Where appropriate, InfluencersPlace may seek payment for work legitimately completed before cancellation.
36. Product-Based Campaigns
Where the Creator receives a product as part of a campaign, the campaign brief should specify whether the product is:
- A gift;
- Compensation;
- A temporary loan;
- Required to be returned; or
- Provided subject to another arrangement.
Creators must return loaned products where required.
37. Events and Travel Campaigns
For campaigns involving events or travel, Creators must comply with agreed schedules, conduct standards, safety requirements, and reasonable event rules.
Unless expressly agreed, Creators should not assume that incidental expenses are reimbursable.
Any flights, accommodation, meals, transport, guest access, or reimbursements should be agreed before participation.
38. Professional Conduct
Creators participating in InfluencersPlace campaigns are expected to behave professionally when interacting with:
- Brands
- Other creators
- Customers
- InfluencersPlace staff
- Vendors
- Event staff
- Members of the public
Harassment, threats, fraud, abusive behavior, discrimination, deliberate deception, or serious professional misconduct may result in removal from campaigns or the platform.
39. Prohibited Campaigns and Content
InfluencersPlace may reject or terminate participation in campaigns involving content that is unlawful or otherwise prohibited by applicable law or platform rules.
Creators may also decline a campaign where they are uncomfortable promoting the product, service, message, or brand.
40. Independent Creator Relationship
Creators participate as independent contractors unless a separate written agreement expressly establishes another relationship. An agreement to this effect must be explicitly written in nature and, on top of everything, must be enforceable by law. All the agreements that are unenforceable by law are outside the purview of any term used in this policy.
Nothing in these Creator Terms creates an:
- Employer-employee relationship;
- Partnership;
- Joint venture;
- Franchise; or
- Agency relationship allowing the Creator to legally bind InfluencersPlace.
Creators remain responsible for their own business activities, equipment, working methods, and applicable taxes.
41. No Authority to Bind InfluencersPlace
Creators must not:
- Enter into agreements on behalf of InfluencersPlace;
- Make commitments on behalf of InfluencersPlace;
- Represent themselves as employees of InfluencersPlace unless they are separately employed; or
- Make unauthorized guarantees regarding InfluencersPlace services.
Furthermore, all other such actions of the creators are also prohibited as might be putting InfluencersPlace in a negatively binding position.
42. Verification
InfluencersPlace may verify creator information using reasonable methods. Verification may include review of:
- Social accounts
- Engagement
- Audience information
- Identity
- Location
- Previous collaborations
- Account ownership
- Campaign performance
Every creator is subject to this verification process. Ensure that all the information that you have provided us is accurate and it matches with the infomration you have furnished on other platforms as listed above. In case of any mismatch found, you will be asked to provide an appropriate explanation for the discrepancy. A verification badge or similar indicator does not constitute a guarantee of future conduct or campaign performance.
43. Suspension or Removal
InfluencersPlace may suspend, restrict, or remove a Creator profile where there is reasonable evidence of:
- Fraud;
- Fake engagement;
- Misrepresentation;
- Serious campaign non-performance;
- Repeated missed deadlines;
- Unauthorized use of brand assets;
- Material confidentiality breach;
- Harassment or abusive conduct;
- Failure to comply with disclosure requirements;
- Material violation of these Creator Terms; or
- Illegal activity associated with the service.
Where practical and appropriate, InfluencersPlace may provide the Creator an opportunity to explain or remedy the issue.
44. Creator-Initiated Account Closure
Creators may request closure of their InfluencersPlace profile.
Account closure does not automatically cancel:
- Active campaigns;
- Outstanding payments;
- Existing confidentiality obligations;
- Agreed content licenses;
- Tax obligations;
- Dispute obligations; or
- Other provisions intended to survive termination.
45. Privacy
InfluencersPlace processes Creator personal information according to its Privacy Policy.
Creators acknowledge that certain profile information is intended to be visible to brands or the public for discovery and campaign purposes.
Sensitive payment, identity, or tax information should only be processed for legitimate operational, legal, or payment purposes.
46. Indemnification
To the extent permitted by applicable law, a Creator may be responsible for losses or claims resulting from the Creator’s:
- Fraud;
- Intentional misrepresentation;
- Unauthorized intellectual property use;
- Material breach of confidentiality;
- Unlawful content;
- Material violation of campaign requirements; or
- Material breach of these Creator Terms.
This provision should be interpreted reasonably and in accordance with applicable law.
47. Limitation of Liability
To the extent permitted by applicable law, InfluencersPlace is not responsible for indirect or consequential loss arising solely from matters outside its reasonable control, including:
- Social platform outages;
- Algorithm changes;
- Account restrictions imposed by third-party platforms;
- Brand business performance;
- Audience behavior;
- Events of force majeure; or
- Third-party service failures.
Nothing in these Creator Terms excludes liability that cannot lawfully be excluded.
48. Force Majeure
Neither party will be responsible for delay or failure caused by events reasonably beyond its control, such as:
- Natural disasters;
- Government restrictions;
- War or civil disturbance;
- Internet or platform outages;
- Major technical failures;
- Public health emergencies;
- Severe transportation disruption; or
- Similar events.
Affected parties should communicate promptly and work reasonably toward rescheduling or another appropriate solution.
49. Complaints and Disputes
Creators should initially raise campaign, payment, or platform disputes directly with InfluencersPlace so that the matter can be reviewed.
Please provide relevant information including:
- Creator name;
- Campaign name;
- Brand;
- Deliverables;
- Payment details;
- Relevant messages;
- Screenshots or analytics; and
- Description of the issue.
InfluencersPlace will review the matter based on available records and applicable agreements.
50. Governing Law and Jurisdiction
These Creator Terms are governed by the laws of India.
Subject to applicable law and any mandatory dispute-resolution rights, disputes arising from these Creator Terms will be subject to the jurisdiction of the competent courts in Gurugram, Haryana, India.
51. Changes to These Creator Terms
InfluencersPlace may update these Creator Terms to reflect changes in:
- Services;
- Platform features;
- Campaign processes;
- Payment systems;
- Legal requirements; or
- Advertising standards.
Material changes will apply prospectively except where an immediate change is required by law or necessary to address security, fraud, or compliance concerns.
The latest version will display its updated effective date.
52. Severability
If any provision of these Creator Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
53. Entire Agreement
These Creator Terms, together with the applicable campaign brief, Terms and Conditions, Privacy Policy, Refund & Cancellation Policy, and any other written campaign agreement, constitute the applicable agreement between InfluencersPlace and the Creator concerning the relevant services.
Where a campaign-specific written agreement expressly conflicts with these general Creator Terms, the campaign-specific agreement will control for that campaign to the extent of the conflict.
